1. Acceptance of these terms
By using the MERL Kenya website or staff portal you agree to these terms and to the Privacy Policy. If you use MERL on behalf of a government office, county or partner organisation, you confirm that you are authorised to do so.
2. The service
MERL Kenya is the Monitoring, Evaluation, Reporting and Learning platform for climate action. It is used by the Ministry of Environment, Climate Change and Forestry, its State Departments and agencies, participating county governments and approved partners to plan projects, report progress and results, review reports and publish approved information to the public.
3. Using public information
- Information on the public dashboards and project pages may be viewed, downloaded, quoted and shared for non-commercial and public-interest purposes, provided you credit the source as "MERL Kenya" and do not misrepresent it.
- Figures reflect what has been reported and approved at the time of publication. They may be revised as new reports are verified, so check the date of any figure you rely on.
- Do not imply that the Ministry, a State Department, an agency or a county endorses your product, publication or conclusions.
4. Staff and partner accounts
- Accounts are personal and are issued by the MERL administrator or your workspace administrator. Do not share your password or let anyone else sign in as you.
- Keep your password confidential and tell the MERL team straight away through the Contact Us form if you think your account has been used by someone else.
- Access depends on your role and workspace. Do not try to view or change records outside your responsibility.
- Accounts may be suspended or deactivated if they are misused, if the holder leaves their role, or to protect the platform.
5. Acceptable use
You must not:
- enter information you know to be false, or alter records to misrepresent progress, spending or results;
- upload files containing malware, or content that is unlawful, offensive or infringes someone else's rights;
- attempt to break into, overload, scan or disrupt the platform, or get around its security;
- collect data from the platform by automated means, except through the official partner API with an issued key;
- use the platform for commercial advertising or political campaigning.
Activity on the platform is logged. Misuse may lead to loss of access and may be referred to the relevant authorities under the Computer Misuse and Cybercrimes Act, 2018 and other applicable laws.
6. Information you submit
- You are responsible for the accuracy and completeness of the projects, reports, figures and evidence you submit. Reports go through review before they are published.
- Only upload photos and documents you are entitled to share. Get consent before uploading images that identify people, and avoid personal details that are not needed.
- Information submitted for official monitoring becomes part of the national monitoring record and may be published once approved.
- Messages sent through Contact Us are handled as described in the Privacy Policy.
7. Availability and accuracy
We work to keep MERL available, secure and accurate, but the service is provided "as is". It may occasionally be unavailable for maintenance or because of problems outside our control. Offline fieldwork is kept on your device until it is submitted; submit it as soon as you have a connection.
8. Limitation of liability
To the extent allowed by law, the Ministry and the operators of MERL are not liable for loss arising from reliance on information on the platform, from interruptions to the service, or from links to external websites. Nothing in these terms limits any liability that cannot be limited under Kenyan law.
9. Changes and governing law
We may update these terms when the platform or the law changes. The date at the top of the page shows the latest version, and continued use means you accept the updated terms. These terms are governed by the laws of Kenya.
10. Contact
Questions about these terms can be sent through the Contact Us form.
